We are part of Maxwood Furniture, Inc. Brands which includes Maxtrix®, Jackpot! Kids Furniture™ and Craft Furniture™. Any reference to Maxtrix®, Jackpot Kids Furniture or Craft Furniture shall here forthwith jointly and collectively be referred to as Maxwood Furniture, Inc. Brands. Please take a few minutes to review these Terms and Conditions. These Terms and Conditions apply to your access and use of the Web Site and our mobile applications. Your use of our Web Site or our mobile application constitutes your agreement to follow these Terms and Conditions and to be bound by them.

THESE TERMS AND CONDITIONS MAY CHANGE

Maxwood Furniture, Inc. Brands reserves the right to update or modify these Terms and Conditions at any time without prior notice. For this reason, we encourage you to review these Terms and Conditions whenever you purchase products from us or use our Web Site.

PRODUCT PRICING INFORMATION

The prices displayed on our Web Site may differ from prices that are available in stores or in catalogues, and our pricing may differ from store to store. If you are on the U.S. or Canada Web Site prices will be displayed in U.S. Dollars. Elsewhere Web Site prices will generally be displayed in the local currency. The prices displayed in our printed catalogues are quoted in U.S. Dollars and are valid and effective only in the U.S.

"Price" refers to the best everyday online value price we offer to our customers. "Final Sale" refers to the products we have on close-out at reduced price we are offering to our customers.

SPECIAL OFFERS

Occasionally we may offer special promotions to our customers that we refer to as "special offers" or "special offer". This can include a gift with purchase, free shipping, manufacturer offers, or other promotional activity associated with a product purchase. These offers may be for a limited time only.

BACKORDERS

Items that are temporarily out of stock and expected to be back in stock within 30 days are available for backorder. Backorder items are clearly indicated and marked with the expected in-stock date on product pages and in the shopping cart.

All orders ship complete; so any order containing a backordered item or component will only ship once the backordered item is available. Tracking information and order status will be provided once the completed order ships. . Any material changes to the expected in-stock dates of back ordered items will be communicated to the customer. Orders may be modified or canceled at any time before shipment.

SHIPPING TERMS & CONDITIONS

When placing an order on our website, it is important to know that visible items are in stock. The data feed for inventory items (products in stock) are based on a live feed. If an item or group of products (such as a bed configuration) is deemed as being “In Stock”, the items or bed combinations are visible. If an item is not visible or identifiable, it is not in stock. Within the 48 contiguous United States we offer: (1) Ground Shipping (US Postal Service, UPS or FedEx), (2) Residential Curbside (Freight/Truck), (3) Premier In-Home Delivery (Professional Crew – 2 Man Team)

We offer FREE SHIPPING on orders over $99.

Shipments totaling $150 or more will require a signature receipt upon delivery. If you have any questions or if you would like to inquire about whether your order will require a signature for delivery, please contact our Customer Service Department at customercare@maxwoodfurniture.com. Nationwide shipping is available to more than 99% of zip codes in the 48 Continental United States. We also offer delivery to customers located in Alaska and Hawaii, but we ask that you contact us for a custom shipping quote. Customers outside the US and Canada, as should also contact us for custom quotes.

If the shipping address provided at checkout needs to be changed for any reason after the item(s) has shipped (whether Ground, Residential Curbside Delivery or Premier In-Home Delivery), re-routing fees and/or administration fees to which the customer will be responsible for said fees.

GROUND SHIPPING DELIVERY INSIDE CONTINENTAL US

Standard Ground Shipping is used for small to medium-size packages. It includes delivery to your doorstep by FedEx or UPS or delivery to your mailbox by the US Postal Service. Shipping charges are based on the dollar amount of your total purchase. The rates below apply to standard ground shipping via courier services (ex. FedEx, UPS, or USPS) in the continental United States. Order Totals Ship Costs Up to $34.99 $6.95 $35 to $49.99 $8.95 $50 to $74.99 $10.95 $75 to $99.99 $12.95 Please note that only some of our products can ship by ground without getting damaged. Ground shipments are at Maxwood Furniture, Inc.’s discretion. Certain products such as dressers, bookcases and desks cannot be shipped by ground.

DELIVERY TIME FOR GROUND FREIGHT SHIPMENTS

Orders placed online may normally take up to 5 business days to process and ship from our warehouse. After leaving the warehouse, approximate transit times vary depending upon delivery location but are generally 5-10 business days anywhere in the continental US. Premier delivery may take slightly longer to process as additional services need to be procured. If you are interested in a rush delivery, please contact customer service to get a custom quote. We will make every effort to stick to the timeline for shipping your purchase, but we are not responsible for unforeseeable or uncontrollable delays. While most orders ship within the time-frame noted, the "Ships In" time is not a guarantee. Furthermore, delivery times and dates are set by third party outside delivery companies, not Maxwood Furniture, Inc., and are subject to change by the third party shipping companies. Maxwood Furniture, Inc. cannot be held responsible for changes or cancellations in delivery dates once the freight has been released from our warehouse. Please keep in mind that estimated lead times do not include holidays and/or weekends.

RESIDENTIAL CURBSIDE DELIVERY

Residential Curbside Delivery (Freight) means your merchandise will be delivered to you by a truck with a one man driver. Some carriers will have a pallet jack in the truck, however the driver is not responsible for off-loading, so you must be prepared to move your merchandise from the truck to its destination. If the order does not contain extra heavy items (70 lb's +), the truck will likely be a regular truck with no lift gate. A responsible adult must be on-site during the entire delivery. Please note that carriers will contact you in advance and set a time window during regular business hours for the delivery to arrive. If you require specific timing of delivery (like early morning or after hours), or if shipments have to be held for an extended period of time at the final mile agent, an extra fee may have to be charged. The driver will not unbox your merchandise. Packaging and shipping materials such as pallets, cardboard boxes and wrapping materials are left behind by the freight company for you to discard. If you foresee limited tractor trailer access, high incline to your destination, unpaved or long narrow driveways or any other known issue that may prevent or affect the delivery with a large freight truck or van, please make sure to notify us by phone +1 877 776 3388 or by email via customercare@maxwoodfurniture.com so that we may assign the correct delivery service. Please Note: Some shipping and delivery options are not available in all areas. If service is not available in your area, we will contact you regarding alternative delivery options.

DELIVERY TIME FOR RESIDENTIAL CURBSIDE SHIPMENTS

Orders placed on our warehouse may take up to 5 business days to process and ship from our warehouse. After leaving the warehouse, the approximate ship time is 5 - 10 business days for the products to arrive at our fulfillment centers or be shipped directly to the final destination. If Maxwood Furniture, Inc. has decided to contract with a delivery service, it may take up to 7 business days for the delivery service to deliver the products. Please note that this decision is exclusively made by Maxwood Furniture, Inc. in order to optimize the delivery. We will make every effort to expedite the production and shipping of your purchase, but we are not responsible for unforeseeable or uncontrollable delays. While most orders ship within the time-frame noted, the "Ships In" time is not a guarantee. Furthermore, delivery times and dates are set by third party delivery companies, not Maxwood Furniture, Inc., and are subject to change by the third party shipping companies. Maxwood Furniture, Inc. cannot be held responsible for changes or cancellations in delivery dates once the freight has been released from our warehouse. PREMIER IN-HOME DELIVERY

Premier In-Home Delivery service means a two man professional delivery crew will arrive with your merchandise at your residence, deliver it inside your home, up one flight of stairs, place the furniture in the room of your choice, un-box your furniture and remove all debris (cardboard, foam wrapping, tape etc.). Assembly of the furniture is not included with this service. In some areas the delivery company also offers assembly for an up-charge and they will offer this to you, if available, upon setting up the delivery schedule. Please email us at customercare@maxwoodfurniture.com if you wish to inquire if this service is available in your area. Please provide ample room for placement of multiple pieces. A responsible adult must be on-site during the entire delivery. For ALL above delivery types by Freight, please make us aware of any specific arrangements needed to gain access to your residence such as spiral staircases, ferry transportation, freight elevator appointments, or additionally insured building insurance, as additional fees or surcharges may apply. If you foresee limited tractor trailer access, high incline to your destination, unpaved or long narrow drive ways or any other known issue that may prevent or affect the delivery with a large freight truck or van, please make sure to notify us. DELIVERY TIME FOR PREMIER IN-ROOM DELIVERY

Orders placed online may take up to 5 business days to process and ship the order from our warehouse. After leaving the warehouse, the approximate ship time is 5 business days for the products to arrive at our fulfillment centers. From there it may take up to 10-15 business days for the delivery service to set up and deliver the products. A representative of the delivery company will call you ahead of time to schedule the delivery date and time. We will make every effort to expedite the shipping of your purchase, but we are not responsible for unforeseeable or uncontrollable delays. While most orders ship within the time-frame noted, the "Ships In" time is not a guarantee. Furthermore, delivery times and dates are set by third party outside delivery companies, not Maxwood Furniture, Inc., and are subject to change by the third party shipping companies. OTHER SERVICES

FURNITURE ASSEMBLY

Our fulfillment partners may offer in-home assembly services in your area. If this is important, please contact us so we may advise if this option is available in your area and we may advise you to contact the delivery and assembly team directly. This service will vary by area and additional fees will apply.

ADDITIONAL CHARGES

Any add-on delivery services that are requested by you (prior to or at the time of delivery) with the freight/delivery company that are not part of the delivery agreement with Maxwood Furniture, Inc. must be paid by you directly with that freight/delivery company. Please be aware that any changes to the delivery contract may incur significant add-on charges as this may include a re-delivery fee, return to warehouse fee etc. If Maxwood Furniture, Inc. erroneously is billed by the freight delivery company for these services, you will be held responsible for any delivery services over and above the delivery agreements that have been made with Maxwood Furniture, Inc. You will be held responsible for making these changes to the delivery contract and for rendering payment for these services. Please read below example.

Example:

The Curbside delivery truck has arrived at the destination. You decide that the items received were heavier or bulkier than expected for you to bring inside yourself and you decide you need a re-delivery of products with an in-home delivery service or you want to get the products brought to the threshold of the home instead of carrying it yourself. Re-delivery will incur re-delivery fees and the extra costs associated with a higher level delivery.

EXPRESS, EXPEDITED OR GUARANTEED SHIPPING

Express Courier Shipping for small and medium sized cartons is available on select items upon request. Expedited Freight Shipping may also be available for larger shipments (shipments that can’t be couriered). Guaranteed Shipping (a shipment to arrive on a specific date) may also be available. Please contact us for pricing and availability by email at customercare@maxwoodfurniture.com , so we can obtain a quote and revert back to you with a cost.

UNDELIVERABLE AND REFUSED DELIVERIES

Undeliverable, missed or refused deliveries that are returned to our warehouse, but rescheduled for delivery will incur ALL additional shipping charges (to the delivery location and back to the original shipping address) and will require payment from the customer prior to delivery. Deliveries that are refused or not scheduled for re-delivery by you within 10 days of notification will be considered abandoned and returned to our facility without refunds or credits. You must be present to receive, inspect and sign for your delivery. Please read “CRITICAL TASKS UPON DELIVERY” below for important information that will help make a delivery successful.

SHIPPING DAMAGES, ERRORS OR SHORTAGES

Please report any shipping damages, errors, or shortages to us within 48 hours of receipt of the shipment. If you fail to notify us within this time frame, we will be unable to file a claim with the freight company on your behalf. No compensation for damaged items will be possible, if proper notification is not received.

OTHER POTENTIAL COSTS AND WAIVERS

STORAGE, RE-DELIVERY AND RETURN FEES

Once your order has been shipped from our warehouse, you will receive an email confirmation with tracking information. Any additional fees associated with shipping that are not part of the original shipping arrangement, included but not limited to: accessorial fees, re-consignment fees, inside delivery, storage, additional services, etc., will be the customers’ responsibility.

INSURANCE

For deliveries made to a building or community that requires an insurance certificate and/or the property owner or management company wants to be named as an "Additional Insured", a $100.00 fee will be added to your order.

3rd PARTY SHIPPING PROVIDERS

If the merchandise is shipped and/or received on behalf of the customer via a 3rd Party (for example (but not limited to) a 3rd Party Warehouse, consolidator, friend, family or neighbor) of the customer from Maxwood Furniture, Inc., the customer will be asked to sign a waiver that releases Maxwood Furniture, Inc. from responsibility for any damages or losses incurred or realized after the 3rd party takes possession of the merchandise. The waiver encourages the customer to advise the 3rd party accepting delivery on their behalf to carefully inspect the item received before accepting the delivery. Once the 3rd Party has accepted a delivery from Maxwood Furniture, Inc., we will not accept returns for items that are damaged or lost.

SHIPPING OUTSIDE OF CONTINENTAL UNITED STATES

We can ship some (but not all) of our products to Hawaii, Alaska, Canada, U.S. Territories, or other international locations. Certain restrictions may apply. Please contact us before placing your order to ensure that we can ship the items you want and to obtain a shipping quote. Shipments to Hawaii, Alaska and U.S. Territories, extra costs for freight will incur. Shipments to Canada, additional costs apply such as freight, taxes, duties and customs is the responsibility of the Canadian customers to arrange, pay for and clear the shipped merchandise. Please note that in the rare case of shipping damage, product defect, or other error, the shipping cost and any other fees related to international shipping associated with sending replacement items will require additional charges. These changes are due to the fact that these areas are outside our regular shipping area and higher freight costs are associated with the shipment. Payment in full is required prior to shipment.

INTERNATIONAL CUSTOMERS

A Worldwide Delivery Service is available for all other countries worldwide (not under sanctions) limited to International Courier services for smaller and medium sized items or LCL shipments for larger shipments. Local rules and regulations may prevent us from shipping products to certain countries. Because safety standards and regulations vary from country to country, please consult Maxwood Furniture, Inc. prior to purchase to ensure we meet your country’s safety standards for selected items.

  • All accounts are prepaid via wire transfer. No product will ship prior to being paid in full.
  • In the event of damage or defect, Maxwood Furniture, Inc. will supply replacement parts,if appropriate. However, due to the exceptional cost of shipping, the replacements will be added to your next shipment rather than shipped or couriered out separately. If you don’t have a next shipment and wish to receive replacement items, we can assist with obtaining a quote and you will be financially responsible for payment of the shipping cost for those items. Payment must be made in full prior to shipment.
  • Maxwood Furniture, Inc. meets or exceeds all safety requirements for sale of our production the U.S. Contact us directly at customercare@maxwoodfurniture.com to see if we are approved for sale within your country.
  • Because laws and regulations are constantly changing, Maxwood Furniture, Inc. cannot beheld responsible for meeting safety standards outside of the United States. As an internationalclient, you are forfeiting any legal recourse against Maxwood Furniture, Inc. for any reason, including injury, death, or failure to meet your country’s standards.
  • If you take possession of the products purchased from Maxwood Furniture, Inc. FOBWarehouse, the possession and responsibility for the shipment will incur immediately after items leave our warehouse. All costs associated with shipping and receipt of goods including but not limited to, shipping damage, customs clearances, duties, and taxes are the responsibility of the client.
  • As an international buyer, you assume all financial responsibility resulting from non-compliance of any of these laws. They include but are not limited to: denial of entry during the import process, fines, additional freight charges, testing fees, VAT etc.

SCHEDULING THE DELIVERY

You will be contacted prior to delivery to arrange the delivery day, which is Monday through Friday between 8 AM - 5 PM. Please note that the type of delivery and shipping address cannot be changed after order placement without incurring extra charges. On the day of your delivery you should make arrangements to be available from 8 AM – 5 PM. An adult must be present. Delivery time windows are estimates which are offered as a courtesy only and cannot be guaranteed due to many factors including weather, traffic, unforeseen complications at previous deliveries, etc. Deliveries are not scheduled by Maxwood Furniture, Inc. but by 3rd party shipping companies.

CRITICAL TASKS UPON DELIVERY

It is extremely important that you follow the below instructions prior to and upon delivery of the furniture so that you don’t incur any unnecessary costs or frustrations. You are responsible for: (1) having a responsible adult available all day and on premises during the entire delivery, (2) receiving the shipment upon notification by the scheduler for truck freight shipments or professional crew deliveries, (3) inspecting and noting any carton or product damage on the delivery ticket upon receipt(please read more below), (4) counting the packages and noting any shortages on the delivery ticket upon receipt, (5) the proper fit of the furniture through your home, up stairways and in the desired room if necessary, (6) prior removal of your existing furniture and providing ample space for the delivery cre wto work (if this service level applies), (7) making sure the ceiling heights are tall enough for the chosen bunk or loft bed, (8) confirming ceiling fans are not within reach of bunks or lofts, (9) providing a safe and normally accessible path from the truck to the delivery point, (10) the accessibility of a large truck or tractor trailer to within a manageable distance ofyour entryway, (11) removal of snow and ice from the driveway and all pathway.

GENERAL INSTRUCTION UPON YOUR RECEIPT OF FURNITURE.

Residential Curbside Delivery Instructions are mentioned first and Premier In-Home Delivery Instructions are mentioned below that. You must inspect the order CAREFULLY for damage prior to signing the delivery receipt. The trucker will ask you to sign this delivery receipt after the products have been delivered. Be sure to follow the below instructions.

ALL CARTON AND/OR PRODUCT DAMAGE MUST BE NOTED ON THE DELIVERY RECEIPT

Inspection of delivery:
  • If a carton seems dented or damaged, open it up immediately and inspect it before you let the delivery driver leave and before you sign the Delivery Receipt. If there is an issue, you MUST note it on the delivery receipt.
  • Claims for damage and/or missing against the freight company cannot be accepted unless the damage is noted on the Delivery Receipt at the time of delivery.
  • Mirrors or glass should be opened and inspected upon receipt as they will not be replaced otherwise.
  • Count the number of pieces received and confirm the quantity received matches the piece count on the delivery receipt.

Damage such as crushed corners, nicks, dings, dents or breakage of any kind is considered freight related. Freight related damage claims will only be honored if you noted the damage on the delivery receipt at the time of your delivery. If an item is visibly damaged... DO NOT REFUSE THE ENTIRE DELIVERY. You may refuse only the specific item(s) that is damaged with a notation on the Delivery Receipt stating which item, type of damage and the condition of the carton/item. Please take pictures to provide proof of damage to us and the trucking company before you send it back with the driver. Please understand that if you sign the delivery receipt as "clear" and without notating any damage, we cannot be held responsible for assisting you in the repair or replacement of the merchandise. Damaged items/parts, so noted on the Delivery Receipt at time of delivery, will be repaired or replaced at our sole discretion and are not eligible to be cancelled. Replacement items or parts items will be shipped as soon as they are available. Always keep the shipping cartons and packing materials for the items for which you wish to file a claim until your claim has been acknowledged and a final determination about the status of the item has been made. Moving, assembling, disposing of cartons & packaging prior to completing the damage claim may limit your ability to receive reimbursement or replacement for those items. The trucking company has the right to inspect the items or original shipping cartons before honoring any claims. Upon filing your claim with Maxwood Furniture Inc., you will receive instructions from the trucking company regarding moving or assembling product. Please notify us by email at customercare@maxwoodfurniture.com of any defect or damage immediately so we can initiate the replacement process with the manufacturer or the trucking company. If you do not receive a confirmation email from us within 1 hour of submitting this email, your request was not received.

PREMIER DELIVERY

You must inspect the order CAREFULLY for damage prior to signing the delivery receipt. The delivery service will ask you to sign this delivery receipt after the products have been delivered. Be sure to follow the below instructions.

Replacement items or parts of items will be shipped as soon as they are available. Always keep the shipping cartons and packing materials for the items for which you wish to file a claim until your claim has been acknowledged and settled. Moving, assembling, disposing of cartons & packaging prior to completing the damage claim may limit your ability to receive reimbursement or replacement for those items. The delivery company has the right to inspect the items or original shipping cartons before honoring any claims. Upon filing your claim with Maxwood Furniture Inc., you will receive instructions from the trucking company regarding moving or assembling product. Please notify us by email at customercare@maxwoodfurniture.com of any defect or damage immediately so we can initiate the replacement process with the manufacturer or the delivery company.

We welcome your comments about our Web Site. However, any comments, feedback, notes, messages, postcards, ideas, suggestions or other communications (collectively "Comments") sent or offered to Maxwood Furniture, Inc.
